By accessing and using Habit2Post ("the App"), provided by Salvatore Castellitti ("we," "us," or "our"), based in Italy, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use this service.

2. Age Requirements

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this requirement.

3. Description of Service

Habit2Post provides AI-powered insights for social media content. We utilize Google AI models to process data and Supabase for secure data storage. Some functionalities rely on unofficial third-party APIs (e.g., unofficial TikTok APIs from RapidAPI) to retrieve necessary public data for analysis.

4. Subscriptions and Payments

Habit2Post offers a subscription to unlock all functionality within the App. By subscribing, you agree to pay all applicable fees and taxes. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing cycle. Refunds are handled in accordance with the applicable App Store policies.

5. Content Ownership

You retain all rights and ownership to the content you submit, post, or display on or through Habit2Post. By using the service, you agree that you own the content or have the necessary permissions to use it.

6. Disclaimer of Guarantees and Liability

Habit2Post is a tool designed to provide insights and suggestions. However, we do not guarantee any specific results. Specifically:

• We do NOT guarantee an increase in followers, engagement, reach, or any other social media metric.
• We are NOT responsible for any bans, suspensions, shadow-bans, or penalties imposed by any third-party social media platforms, including but not limited to TikTok.
• We are NOT liable for any damages, loss of profits, data loss, or other intangible losses resulting from the use of our service or reliance on unofficial third-party APIs.

7. Third-Party Platforms and TikTok Disclaimer

Habit2Post is an independent tool and is not affiliated, associated, authorized, endorsed by, or in any way officially connected with TikTok, ByteDance Ltd., or any of their subsidiaries or affiliates. Any references to TikTok or other social media platforms are for descriptive purposes only.

• You acknowledge that all content, data, usernames, videos, captions, comments, and other material analyzed through Habit2Post are provided or controlled by you or the applicable platform, not by Habit2Post.
• You are solely responsible for ensuring that your use of Habit2Post complies with the terms of service, community guidelines, and policies of TikTok and any other platforms you connect or reference.
• Habit2Post does not have control over, and assumes no responsibility for, any actions taken by TikTok or other platforms in relation to your accounts or content, including moderation decisions, removals, or enforcement actions.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.
